Terms and Conditions

 

 

1. Session Fees

Client agrees to pay a booking fee to book a session. This is a non-refundable fee that covers the time and talent of photographer, use of props, and creative editing of images, as determined by the photographer. Any print products  that maybe included with in your session fee will have our company logo on. Print products and digital files will be available for purchase during the viewing/ordering session (these print products will not have our company logo on)  Please be sure to review all pricing details. There are no refunds or exchanges of any kind due to the custom nature of portrait photography.

2. Rescheduling

If an illness or situation of the client prevents a photo session from taking place, the client may reschedule the session at least 24 hours prior to the shoot without penalty. Should the client fail to give 24 hours notice, or decide to completely cancel the shoot, this booking fee is forfeited and will not be refunded. The photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond her control.

3. Re-shoots / Refunds

Re-shoots are determined at the discretion of the photographer. There are no refunds.

4. Archive

After sixty (60) days, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. The photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.

 

5. Payment

All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received. All payments must be cleared before any products can be ordered.

 

6. Liability

Client is aware that the quality of the end result print of the digital files delivered is not under the control of the photographer and frees the photographer from any liability for any claims whatsoever based upon discoloration in the end result print. The photographer is not responsible for the quality of services provided by its business partners.
If the photographer cannot fulfill this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness or emergency, then the photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the retail value of the client’s order. The client releases Donna Richens, and all employees of Creative Capture Photography, from all liabilities, claims and damages that may result from any accidents or incidents that may happen during the session.

 

7. Your Session

Newborn sessions are conducted at the photographer’s home studio located at 12 Mead Close, Tilehurst, Reading. RG31 4ET
Clients should be prompt for the session. The photographer has scheduled around the “sleepiest” times. Newborn sessions begin usually at around 9:30 to 10.30 am and 1.30 to 2.30 pm For newborn sessions the photographer allows a 30 minute cushion as getting out of the house with a new baby can be difficult. Arriving late to the appointment will result in lost session time. If the client is running late, he/she must notify the photographer. The session may need to be rescheduled if the client arrives over 30 minutes after the scheduled start time. If the client fails to show for the scheduled appointment or the session has to be rescheduled due to tardiness, an additional £50 deposit will be required to reschedule.
The client should take the time to review samples of the photographer’s work to make sure that her style of photography and editing is a good fit. When a client books with with Creative Capture Photography, he/she gives the photographer full reign over session styling and artistic editing of photos. The photographer will be choosing the props that will be used and the best of the images to edit and present so if the client has specific likes or dislikes these should be discussed well in advance of the session. It is the photographer’s goal to provide all clients with pictures that they will love. During the session, the photographer Donna Richens and her assistant will handle baby throughout the session, comforting, soothing and posing baby.  Her newborn editing workflow includes brightening, removing any baby acne and prominent skin flakes, reducing redness and yellowing caused by jaundice, softening skin to even out blotchy skin and give a smooth texture, sharpening to bring out features & some composite images that are required.

 

8. After the session

At the time of the session or when your images are ready a viewing/ordering session will be scheduled (within three weeks). At this time the image gallery will be presented and products may be purchased. All parties that will need to be involved in the financial decision must be present. Please note, again, there no refunds or exchanges on fees paid due to the custom nature of portrait photography.

9. On-line gallery

Your on-line gallery will be live for fourteen days (14) after your viewing session at the studio. A minimum order is required at current rate (please ask for details) After this time your gallery will be removed and a fee incurred if you wish it to be re-instated. No photographs bought through the gallery are to be scanned or copied in any way.

10. Online Sharing

Only images that are watermarked and specially formatted for web viewing by Creative Capture Photography can be posted or shared online. Images may not be altered in ANY way by the client (no cropping, black/white conversion, filters, etc.). Clients may NOT post the high resolution print files online. Clients are advised to turn off Facebook’s “photo enhancement” feature before posting images as it will greatly distort the image quality.
Creative Capture Photography may post a favourite shot(s) from the session on the Facebook fan page, blog or website,once product purchases have been made and encourages the client(s) to tag himself/herself and share with friends and family. Please note that clients are allowed to use these on their Facebook Profile as long as the watermark remains fully intact, and the photo is not altered or cropped in any way.

11. Copyright & Penalty

Creative Capture Photography retains all copyrights to all images created during client’s session and will at times use images for promotional purposes, such as blog posts, facebook fan page, website and promotional products. Clients can opt out of promotional sharing, please make wishes known in writing at time of booking.  A print release will be provided with digital files to print portraits for personal use (Where purchased) The print release does not allow publication of the portraits (i.e. entering in contests), selling or altering of the images without the photographer’s written permission.
